Unmarried Couples

Unmarried couples in Connecticut may encounter the same issues as divorcing or separating couples – dividing assets, family income, and creating a parenting plan. If there are children involved, the case is commenced with an Application for Custody. Financial issues between the parents can be resolved under that umbrella. The case then follows a path similar to that of a divorce.

Couples without children can file a formal civil case to divide property. Nevertheless, many couples choose to work out a mutually agreeable arrangement to resolve financial issues, either in mediation or through a collaborative process. This process culminates in a contract between the couple that can be enforced if either one does not comply with the agreed-upon provisions, but no court case is filed. We have found that this method for resolving issues for unmarried couples has worked well.

Unmarried couples do not have the benefit of certain favorable tax provisions for the transfer of income and assets, and thus any contract created must be done carefully. Louden Legal Group can help evaluate the specific details in a situation and help with deciding how to proceed.
